Policy For Corporate Event Photographic Services
We thank you for selecting us, as your photographers, for this special event. Below is our super simple photography policy that will help ensure you get the most out of your photography service.
1. Services.
Upon invoicing, agreement signature and/or client retainer, Photographer(s) shall reserve the date and time agreed upon, and will not make any other reservation for that date and time. For this reason, all retainers are non-refundable, even if the date of the event is changed or event is cancelled for any reason.
2. Terms.
No part of any order, including previews, will be delivered until the balance is paid in full. Payment for prints/paper products is required in full at the time of placing an order. Client will receive photos on digital download, USB Thumb Drive or CD with print release for Corporate Internal Marketing use only. Digital download includes images for company’s website, social media (Facebook, Instagram, etc), or email. Client also understands that when publishing photos on websites, i.e. internal company website, Facebook, etc., he/she/they will not edit the photos in any way, i.e. editing the watermark, cropping, stickers, filters, etc! NO EXCEPTIONS.
3. Payments
A retainer may be requested and if so is due at signing to hold the date. The retainer required for event photographic services starts at $250. The complete balance must be paid in full before any previews or deliverables are completed. All deposits and payments are non-refundable.
4. Processing Time
Completion of processing and edits of event photographic services may take up to one (1) to five (5) days from the last date of service (event date). Last date of service includes but is not limited to date of final payment, date of last photographic service or any other service(s) rendered in association with the event.
5. Digital and Print Publishing.
Client agrees to give Cocoa & Co. photo credit, using the phrase, “photos by Cocoa & Co.”, when publishing, either online or in print, any or all Digital Images, by Cocoa & Co. All images by Cocoa & Co. displayed online, in print or onscreen will include the Cocoa & Co. watermark. NO EXCEPTIONS. Un-watermarked images can be leased by request.
6. Ownership Of Photos
By retaining Cocoa & Co. services you agree that the images being provided to you are licensed to you for marketing use only (unless directly stated); including: printing, emailing, and web publishing. Your license does not include any use that results in financial gain directly or indirectly, including but not limited to: marketing or advertising (paid or unpaid) by you or any other third-party, stock photography, print sale profits or credits, resale, relicensing or loan of images of any nature.
7. Social Media Usage Agreement
By ordering any digital products/photos [art, graphics, designs, digital downloads, proofs, poses or alike] from Cocoa & Co. you agree to use the delivered photos in the following way: post photos to social media sites, only in the case that Cocoa & Co. is credited in the post[using @thecocoanco] AND the photo description [using @thecocoanco] AND tagged [using @thecocoanco]. You may not edit, alter or remove any Cocoa & Company, Ltd. watermark(s) and/or overlays/branding, add filters, stickers or alter the images in any way; the photo must stay visible in the way in which it was provided to you, doing otherwise is a violation of this policy and you may be subject to financial damages and/or a revocation of your right to use the images. Additionally, it is understood that you are permitted to click the “share” button on any photos posted to Cocoa & Co’s facebook (http://www.facebook.com/thecocoanco) page. Sharing can NOT be done via screenshots of photos on Facebook, Instagram, Google, Twitter or any webpage/gallery from the Cocoa & Co. website.
8. Copyrights and Usage.
NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs without Photographer’s written permission, and violators of this Federal Law will be subject to its civil and criminal penalties. Photographer retains copyright to the photographs. “Do I get the copyright to my images?” This is the most frequent question we're asked when meeting with new clients. So to help provide you with peace of mind when you receive "DIGITAL DOWNLOAD" it includes a print release.
A print release allows our client(s) to print the images for marketing use (such as display in your office, signage, posters, etc) and even share online in places such as Facebook and internal website. What a print release does not allow: editing the image in any way, selling the image, using the image without express written permission from Cocoa & Co. in trade agreements/contests/press/media, etc.
